Scary Legal Stuff
Following the approval of a proposal, the client will receive a copy of the client contract and be asked to review and sign before the project officially begins. A full copy of the client contract is available upon request. The main points of the contract are covered below.
Fees and Billing
All consultations are free. A proposal with a breakdown of estimated costs will be sent to the client 3-5 business days after the initial consultation.
Clients may choose to be billed either per project or monthly for ongoing work. Larger scale projects may require a down payment of up to 50% of the estimated final total, which will be noted in the initial proposal.
Quotes & Estimates
Quotes and estimates created for a client before a project are estimates of the project cost based on the scope of work discussed at the initial consultation. If the needs of a project change, or the final deliverables are changed, the project cost will need to be reassessed.
Mad Skills Digital Media will notify the client of any additional or unforeseen costs that arise during the course of the project and will not proceed before receiving the client’s approval.
Expenses & Reimbursements
To expedite the completion of projects, Mad Skills Digital Media can pay upfront for certain expenses (printing, online advertising, website fees, project-specific video/photo props, etc.). Clients will be notified of these expenses before they are incurred, and all such expenses will be added to the client’s next invoice for reimbursement. Of course, clients can pay these expenses up front themselves.
Client Reviews/Proofs
Photography - Upon delivery of finished photos, the client may request one-time editing revisions. Reshooting any photos will incur an additional fee that is determined on a case by case basis.
Video - Mad Skills Digital Media will deliver a rough cut with watermarks at a date specified in the initial consultation or at the time of filming. The client may request a maximum of two reviews to offer feedback before the delivery of the finished project.
Graphic Design - Clients will be asked to review proofs at various stages throughout the graphic design process (concept, color, texture, font, etc.) before the final version is delivered. The Mad Skills Digital Media logomark will be left on photographs/videos/graphics for all proofs or review copies, and will be removed for final deliverables.
Social Media - Clients may request a copy of the Planning Grid used by Mad Skills to plan a profile’s content calendar for approval up to one month in advance. The client may request one-time revisions to the content calendar before posts are scheduled. The client can also view scheduled content for Facebook an Instagram in their Meta Business Suite account.
Website - Client reviews for websites in development are determined on a case by case basis.
Deliverables
Photography & Videos
The Mad Skills Digital Media logomark will be left on photographs/videos/graphics for all proofs or review copies, and will be removed for final deliverables. Finished digital files will be delivered to the client via email or dropbox. Files can be delivered on a physical storage device (such as a thumb drive or DVD) for an additional fee.
Graphic Design
Prints of finished graphic designs are available upon request. The client will be notified of estimated printing costs before items are sent to print. These charges will then be added to the client’s next invoice in order to reimburse Mad Skills Digital Media.
Social Media
Content posted on social media is considered “delivered.”
Ownership of Media
All finished media is owned by the client, with Mad Skills Digital Media maintaining the right to showcase content for the purposes of marketing to future clients both in social media and on the Mad Skills website. The client may request that sensitive content (such as images or video containing proprietary information) not be shared beyond the client’s organization.
Content Storage
Photography/videos/Graphic Design
Mad Skills Digital Media will maintain storage of finished photo/video/graphics projects for a period of two years. If the client needs another copy of any photos, graphics or videos within that period, Mad Skills can provide a downloadable version via Dropbox, or a physical copy for an additional fee. Availability of any project files older than 2 years cannot be guaranteed.
Social Media Content
Mad Skills Digital Media cannot guarantee access to the original files used for social media content after it has been posted. Finished content files are stored within the client’s social media profile and can be accessed there at any time.
Consent
Written release forms will be provided alongside the client contract and must be signed and returned before the start date of the project. These forms give Mad Skills Digital Media the signer’s consent to use their likeness for digital marketing purposes on behalf of the client and for promotional purposes for Mad Skills Digital Media.
Privacy & Security
Mad Skills Digital Media may require personal information or login credentials for client websites or social media accounts to perform marketing services. This information will be securely stored for the duration of the project and destroyed upon its completion. Any potential security breaches will be reported to client immediately.
If a project involves the photography/recording of sensitive or confidential material, Mad Skills Digital Media will, within reason, take measures to maintain confidentiality of sensitive materials.
Technical Difficulties
Mad Skills Digital Media cannot be held responsible for unforeseen technical problems (hardware/software malfunctions) that interfere with the completion of a project. Clients will be notified of any project delays.
Job Termination
If either party chooses to terminate a contract, Mad Skills Digital Media will issue an invoice for un-billed hours. After payment has been made, all media held by Mad Skills and ownership thereof will be transferred to the client with watermarks removed.
